Re: [RPPTL-constructionlaw] foreman -GC relationship
Query: I have a General Contractor (fully licensed in FL) who has a relationship with a foreman that is NOT licensed. The Foreman is well connected in the insurance industry with LOTS of referrals. The GC wants to create a relationship with the foreman whereby he gets the referrals and they share costs and profits 50/50 but he does not give up control. What is the best way to accomplish this?
A. independent contractor relationship whereby GC hires foreman's company as a foreman (does the foreman have to be independently licensed for this arrangement?)
B. Employment agreement (I don't like this idea because all money going to employee is taxable)
C. mixed employment agreement plus 20% stock (upon break up how do you get the stock back?)
D. construction manager - licensure required?
E. other -do you have a better idea?
