Landlord evicts tenant from residential single family home for non-payment of rent. When sheriff executes writ of possession, landlord discovers that tenant had created two efficiency apartments on the property. The sheriff refused to execute the writ of possession on the two newly discovered efficiency apartments. Occupants were present at the time sheriff executed writ and simply stated they were not moving. I have filed a motion to enforce the final judgment of eviction and for an alias writ of possession and served the two newly discovered occupants, in an effort to get them out and avoid having to file new cases for unlawful detainer.
