[RPPTL LandTen] Force Majeure??

Hi All,

This is really not landlord/tenant related but a property management group
had me booked to do a property management legal training event in mid August
and the group is cancelling it.

The hotel wants to charge them over $14,000 because of them cancelling.  It
will clean out the association if they even have that much money.

It has a force majeure clause (attached)

Do these clauses go both ways?  Anyone represent any organizations that are
dealing with this?

Harry

Hi Harry. This one appears to go both ways, however, cancellation due to COVID-19 is not covered unless by some stretch you can argue that it is an act of God which I think is a long shot, but I've not done any research to back up my opinion.  If the city shut down all events for their planned dates, I think that would be covered under this force majeure clause.

Brenda

Best regards,

That agreement does go both ways, but you would need a "circumstance making it illegal or impossible to use hotel facilities."  You may be able to find an argument regarding "illegal or impossible to use hotel facilities," but you are going to have to dig.  I would research the state, city and county orders/regulations in effect where the hotel is located which could support that argument.
