Maybe somebody could notify the Judges that the Moratorium is limited in scope because I can't get any of the Judges to even set a hearing or sign an FJ no matter what type of case. Even commercial cases that were filed pre-Covid are frozen here in PBC. If it says "Eviction" they won't touch it.

The only way we are going to get anywhere is if the Supreme Court gives out an AO that makes sense.
We operate all over the state and it is totally inconsistent. We are contacting tons of Clerks a week to get answers and getting nowhere.
The closest contact we have to the Supreme Court Administrator is through someone else.
There are serious situations where tenants have committed crimes, are dealing drugs, causing massive disturbances and sitting there with us not being able to do a thing.
The Writs are just hung up.
The irony of it all is that throughout this huge mess, the Clerks have allowed the filing of thousands of nonpayment cases all over the state.
Just talked to an attorney yesterday that is loving this. He is getting cases dismissed, going after fees and is going after landlords under the FCCPA as well. He plans on going after lawyers who have filed nonpayment cases in violation of the EO and I don’t blame him.

Same goes for foreclosure sales of vacant condo units or land. They see a looming “foreclosure sale” and auto cancel.

I had a judge just sua sponte cancel a motion calendar hearing I set on a
motion for judgment on the pleadings in a hold over (not non payment)
eviction case friday with a note that “all eviction cases require pre
approval of the court to set any hearing.”
Absurd.
I am going to upload a proposed Order granting it with a cover letter
requesting an immediate hearing (these are statutorily cases that are
required to be advanced on calendars) if not being granted and if that does
not happen may well file a mandamus action. My client is over it, as am I.
In this case, by the way, the woman (who also has not paid since March)
objected to the hearing date because she was working and wanted it between
12 and 1 or after 5...

Things are getting very out of hand. I can’t get a hearing on a unlawful detainer where a person slept two nights at my client’s house, then changed the locks on a guest bedroom when he left for a few hours, and has now put up security cameras.
