Barry,

My legislative tracker shows that the HB 283 Lien Law Bill has been referred to three Senate committees as of today. It seems to suggest that the HB 283 has not yet died in the Senate.

Can you confirm that I am correct that it has not died?

That’s procedural.  It happens with every House Bill that has been approved by the House and sent to the Senate.  The problem is no Senate Committees are continuing to meet. That’s why the Senate Bill (SB 868) and HB 283 are effectively dead.

liens less than $30k?
Circuit (chancery) and 26 or
the new jurisdictional limits
that say $30k below???
Can’t find any direction.
Don’t want to incorrectly file
and have the year run and
then call the carrier time:)
Thanks

I believe there is a case holding that County Court has concurrent jurisdiction with Circuit Court to foreclose liens within their jurisdictional limit (at the time under $15k).  Accordingly, for liens under $30k, you ought to be able to file in either County Court or Circuit Court and have the Court vested with jurisdiction to handle the matter.

[EXTERNAL EMAIL]
Barry,

My legislative tracker shows that the HB 283 Lien Law Bill has been referred to three Senate committees as of today. It seems to suggest that the HB 283 has not yet died in the Senate.

Can you confirm that I am correct that it has not died?

This was cleared up by the addition of sub-section 4 to section 34.01 a number of years ago which gave county courts equity jurisdiction:

I believe there is a case holding that County Court has concurrent jurisdiction with Circuit Court to foreclose liens within their jurisdictional limit (at the time under $15k).  Accordingly, for liens under $30k, you ought to be able to file in either County Court or Circuit Court and have the Court vested with jurisdiction to handle the matter.

Hey, bad to butt in, I know,
But...what are folks doing with
liens less than $30k?
Circuit (chancery) and 26 or
the new jurisdictional limits
that say $30k below???
Can’t find any direction.
Don’t want to incorrectly file
and have the year run and
then call the carrier time:)
Thanks

(4) Judges of county courts may hear all matters in equity involved in any case within the jurisdictional amount of the county court, except as otherwise restricted by the State Constitution or the laws of Florida.

Barry,

My legislative tracker shows that the HB 283 Lien Law Bill has been referred to three Senate committees as of today. It seems to suggest that the HB 283 has not yet died in the Senate.

Can you confirm that I am correct that it has not died?

If a recipient of this e-mail communication is not an addressee (or an authorized representative of an addressee), such recipient is hereby advised that any review, disclosure, reproduction, re-transmission or other dissemination or use of this e-mail communication (or any information contained herein) is strictly prohibited. If you are not an addressee and have received this e-mail communication in error, please advise the sender of that circumstance either by reply e-mail or by telephone at (800) 356-6818, immediately delete this e-mail communication from any computer and destroy all physical copies of same. Replies Filtered: Any incoming reply to this e-mail communication or other e-mail communication to us will be electronically filtered for "spam" and/or "viruses." That filtering process may result in such reply or other e-mail communications to us being quarantined (i.e., potentially not received at our site at all) and/or delayed in reaching us. For that reason, we cannot guarantee that we will receive your reply or other e-mail communications to us and/or that we will receive the same in a timely manner. Accordingly, you should consider sending communications to us which are particularly important or time-sensitive by means other than e-mail. [v4.30]
