Licensing Help

Good morning everyone,

I have a construction client whose qualifier left and they filed an application for a new qualifier a few months ago.  DBPR is still processing it at the speed of molasses and refuses to do anything to expedite the review.  They gave us the 60-day temporary license, but it expires Monday and we still can't get anyone to put eyes on the application.  Our request for an extension of the temporary license was rejected by the DBPR Executive Director, who claims they lack the authority to do so.  So we can't get anyone to just look at the application, we can't get an extension of the temporary license and my client will have to shut down operations on Monday.

Any suggestions?

Thanks a lot.

Good morning everyone,

I have a construction client whose qualifier left and they filed an application for a new qualifier a few months ago.  DBPR is still processing it at the speed of molasses and refuses to do anything to expedite the review.  They gave us the 60-day temporary license, but it expires Monday and we still can’t get anyone to put eyes on the application.  Our request for an extension of the temporary license was rejected by the DBPR Executive Director, who claims they lack the authority to do so.  So we can’t get anyone to just look at the application, we can’t get an extension of the temporary license and my client will have to shut down operations on Monday.

Any suggestions?

Thanks a lot.

Lee,

Has your client tried used the online portal to check the status of the application using SSN or TaxID? If it shows that it is “deficient”, there might be an issue delaying the process. Did the company receive any deficiency letters from DBPR ? Usually this is via email (check spam folder).  Call 850-487-1395 and provide application number or SS to see if they see a deficiency and what must be done. Hope this helps.

Unfortunately, I do believe that the 60 -day Temp License cannot be extended.

Lee- Assuming the new qualifier is already employed by your construction
client, you may have grounds to argue for a further extension or even a
right to continue contracting during the review period, based on compliance
with Florida Statute 489.119(3)(a).

(3)(a) A qualifying agent must be certified or registered under this part
in order for the business organization to operate in the category of
contracting in which the qualifying agent is certified or registered. If
any qualifying agent ceases to be affiliated with a business organization,
he or she shall inform the department. In addition, if the qualifying agent
is the only certified or registered contractor affiliated with the business
organization, the business organization shall notify the department of the
termination of the qualifying agent and shall have 60 days from the
termination of the qualifying agent's affiliation with the business
organization in which to employ another qualifying agent. The business
organization may not engage in contracting until a qualifying agent is
employed, unless the executive director or chair of the board has granted a
temporary nonrenewable certificate or registration to the financially
responsible officer, the president, a partner, or, in the case of a limited
partnership, the general partner, who assumes all responsibilities of a
primary qualifying agent for the business organization. This temporary
certificate or registration shall only allow the business organization to
proceed with incomplete contracts. For the purposes of this paragraph, an
incomplete contract is one which has been awarded to, or entered into by,
the business organization prior to the cessation of affiliation of the
qualifying agent with the business organization or one on which the
business organization was the low bidder and the contract is subsequently
awarded, regardless of whether any actual work has commenced under the
contract prior to the qualifying agent ceasing to be affiliated with the
business organization.

Lee- Assuming the new qualifier is already employed by your construction client, you may have grounds to argue for a further extension or even a right to continue contracting during the review period, based on compliance with Florida Statute 489.119(3)(a). (3)(a) A qualifying agent must be certified or registered under this part in order for the business organization to operate in the category of contracting in which the qualifying agent is certified or registered. If any qualifying agent ceases to be affiliated with a business organization, he or she shall inform the department. In addition, if the qualifying agent is the only certified or registered contractor affiliated with the business organization, the business organization shall notify the department of the termination of the qualifying agent and shall have 60 days from the termination of the qualifying agent's affiliation with the business organization in which to employ another qualifying agent. The business organization may not engage in contracting until a qualifying agent is employed, unless the executive director or chair of the board has granted a temporary nonrenewable certificate or registration to the financially responsible officer, the president, a partner, or, in the case of a limited partnership, the general partner, who assumes all responsibilities of a primary qualifying agent for the business organization. This temporary certificate or registration shall only allow the business organization to proceed with incomplete contracts. For the purposes of this paragraph, an incomplete contract is one which has been awarded to, or entered into by, the business organization prior to the cessation of affiliation of the qualifying agent with the business organization or one on which the business organization was the low bidder and the contract is subsequently awarded, regardless of whether any actual work has commenced under the contract prior to the qualifying agent ceasing to be affiliated with the business organization.
