[RPPTL LandTen] Evictions during EO hold
Here is some interesting press info about the fact that landlords, property
managers and maybe even lawyers are STILL filing Nonpayment of Rent
evictions during the 45 Day Hold.
I would imagine that this is a statewide problem.
There are 2 AG offices taking action that I have found so far.
On social media the "document preparers" who basically give legal advice and
file evictions with impunity or, sign affidavits stating that they are the
property manager, WHEN THEY ARE NOT, are telling people that they CAN file
Nonpayment of Rent evictions and the Clerk of Court is accepting them.
Block your phone number, call a "document preparer" and they will give LEGAL
ADVICE all day long.
These "document preparers" are of course using the Supreme Court Approved
forms which killed off a lot of the basic legal work that new attorneys did
in the past and cause great public harm.
How the Bar helped these people to STEAL business from attorneys is mind
blowing.
Ironically, many of them charge MORE for evictions than I do and then feed
the contested cases to lawyers.
I hope lawyers take these cases on behalf of the tenants and nail the
landlords to the wall with attorney fees judgments. I routinely see $5000
to even $37,000 awards of attorney's fees when the tenant's lawyers get
these cases dismissed and go for the multiplier.
There is a company in Tampa that has been doing this for years and even has
his own box where the clerk's staff put his papers for pick up by the
process servers.
No one is stopping this. God help the young lawyer trying to start out
today.

A process server I use says a lawyer in Broward has been filing and giving
him nonpayment residential evictions and he has been serving them. I
believe Dade county will not issue the summons for new evictions.

Correct, Miami-Dade is not issuing summons and Broward is not entering defaults (pursuant to admin order).
