All:
Wondering if anyone can tell me whether Clerks in Broward County are issuing
summonses in commercial evictions. I understand commercial evictions are
not included in the Governor's order, but I have heard anecdotal evidence
that some courts are not proceeding with commercial evictions.
Thanks.

As an extension Scott's question..even if we get Summons, anyone have any
experience with getting a Writ of Possession issued (in a commercial
eviction) and service of same...also Broward County, inquiry.

All writs are stopped, but I did get a summons from Broward last week.

I believe Broward is issuing summonses on both residential and commercial
cases. But as per administrative order 2020-32-Temp, you can't get a
default or writ of possession until the Court resumes normal operations.

Unfortunately for those of us who represent Landlords, the Supreme Court
Emergency Order was not specific to residential. They wrote:
Supreme Court of Florida Administrative Order Number AOSC20-17 In Re:
COVID-19 Emergency Measures In The Florida State Courts
WRITS OF POSSESSION
Given the exigencies of the public health emergency, the requirement in
Florida Rule of Civil Procedure 1.580(a) for the clerk to issue a writ of
possession “forthwith” shall be suspended through the close of business on
Friday, April 17, 2020, or as provided by subsequent order.
That provision was extended through May 29th by subsequent Order.
