Hi Neil and listmates -

I attended via phone and very much enjoyed the statutory revision
discussion and Julie's additional insured endorsement presentation.

I'm hopeful that we'll continue to get updates on the proposed 713.10
revisions. Even though I practice construction and lien law as well (or
maybe because I do), I'm somewhat concerned about the fig leaf being
offered to the construction practitioners in the form of a tenant
improvement allowance lien right, though I agree with the spirit of such
a concept. It would seem to create a novel creature of (non
real-property) lien law along with all the procedural, priority, and
foreclosure issues that such a carve-out might entail. The other
proposed changes are an outstanding effort to clarify an otherwise
confusing scheme.

Hi Neil and listmates -

I attended via phone and very much enjoyed the statutory revision discussion and Julie's additional insured endorsement presentation.

I'm hopeful that we'll continue to get updates on the proposed 713.10 revisions. Even though I practice construction and lien law as well (or maybe because I do), I'm somewhat concerned about the fig leaf being offered to the construction practitioners in the form of a tenant improvement allowance lien right, though I agree with the spirit of such a concept. It would seem to create a novel creature of (non real-property) lien law along with all the procedural, priority, and foreclosure issues that such a carve-out might entail. The other proposed changes are an outstanding effort to clarify an otherwise confusing scheme.

Hello all,

By now everyone has probably examined the new condo law and seen the slew of letters flying from the HOAs and CAs to the tenants with the rent demand for PAST and CURRENT amounts owed .

What is the consensus on what they can demand? If they demand the wrong amount they are violating state debt collection laws. Are they "debt collectors" "original creditors" Do they have to follow the FDCPA?

Can they demand future amounts owed, current amounts owed, past amounts owed? I believe the intent of the law was ANY amounts owed but that is not what the law says and the demand letters are ALL asking for all money owed and it is old money owed.

This is a HUGE issue. Even Becker-Poliakoff is not publicly saying what the deal is and recommend a "conservative approach"

Something to ponder over the weekend and fix next year.
