Residential contractor warranty

Hello folks,

I have a relative who is a residential contractor. He made

reference to what he believed was a statutory requirement that residential
builders provide a warranty of a minimum of one year to the owner.  Most of
my practice involves commercial payment issues (i.e. liens and surety bond
claims).  I reviewed Fl. Stat. ch 558 but did not see such a requirement.
Is anyone aware of such a statute and, if so, could you provide a citation?

Thank you very much.

718.203 FS - the condo statute - provides different warranties and time periods from the developer to the purchaser of a unit. I have also heard about the 1 year warranty from a builder to the owner of a residential parcel, but have not seen any statutory authority.  My guess is that might be something the builder gives to the owner directly as part of his business practice.  Arlene

You have the statutory condominium warranties in 718.203.  Other than that,
I don't know of a statute either.  It has been in the AIA forms (and now
ConsensusDocs) for so long it has hardened from a contract option through
usual to required.

To the best of my knowledge only condominiums (associations, owners &
developers) have statutory construction warranty rights in Florida (The
UCC also provides some warranties but these can be difficult to apply to
a construction setting).

Unless express, all other construction related warranties come from
common law.  There was an article written in the Florida Bar Journal a
few years back that does a good job of giving a general overview of
Florida warranties in the construction setting ( let me know if the link
doesn't work and I can give you a cite).

Subject: [CLC-Discussion] Residential contractor warranty

Hello folks,

I have a relative who is a residential contractor. He made

reference to what he believed was a statutory requirement that
residential
builders provide a warranty of a minimum of one year to the owner.  Most
of
my practice involves commercial payment issues (i.e. liens and surety
bond
claims).  I reviewed Fl. Stat. ch 558 but did not see such a
requirement.
Is anyone aware of such a statute and, if so, could you provide a
citation?

Thank you very much.

To the best of my knowledge only condominiums (associations, owners & developers) have statutory construction warranty rights in Florida (The UCC also provides some warranties but these can be difficult to apply to a construction setting). Unless express, all other construction related warranties come from common law. There was an article written in the Florida Bar Journal a few years back that does a good job of giving a general overview of Florida warranties in the construction setting ( let me know if the link doesn't work and I can give you a cite). http://www.floridabar.org/divcom/jn/jnjournal01.nsf/Subjects/031A209353C 755C385257589006E95FE Edward C. Subject: [CLC-Discussion] Residential contractor warranty

Hello folks,

I have a relative who is a residential contractor. He made reference to what he believed was a statutory requirement that residential builders provide a warranty of a minimum of one year to the owner. Most of my practice involves commercial payment issues (i.e.

liens and surety bond claims).  I reviewed Fl. Stat. ch 558 but did not see such a requirement.

Is anyone aware of such a statute and, if so, could you provide a citation?

Thank you very much.

Steven F. Thompson, Esq. Thompson & Brooks 412 E.
