RPPTL PT Division EC Members 2025-26
View all threadsGood evening,
To those RPPTL Probate and Trust Division Committee Chairs who were able to attend the meeting today, thank you. (Note – this meeting was for Committee Chairs only, so if you are a Vice Chair, don’t worry. You did not miss a meeting; and I suspect your committee chair will be filling you in, as needed).
REMINDERS:
· Our next Executive Council meeting is December 6, 2025 at the Four Seasons in Orlando.
· As a Chair and/or Vice-Chair of a Section Committee, YOU are a member of the EXECUTIVE COUNCIL. If you are not a past-Chair of the Section and wish to remain a member of the Executive Council, you are required to attend TWO (2) in-state EXECUTIVE COUNCIL meetings IN PERSON (NOT BY ZOOM) during the Bar year (July 1 – June 30). Your failure to ensure your attendance is accurately recorded (or timely request attendance waivers for good cause) will result in you being “deemed” to have resigned your leadership position and render you ineligible to be appointed as a Chair or vice-Chair the following year. Your attendance at a Committee Meeting DOES NOT COUNT toward EC Meeting attendance. NOTE: this applied to more than 20 members of the PT Division last year. Don’t be THAT person
· Committee Chairs - On or BEFORE 9/23/25, please reply to me sancha@zkslaw.commailto:sancha@zkslaw.com AND Hilary Stephens hstephens@floridabar.orgmailto:hstephens@floridabar.org with answers to the following questions (include the title of your committee, please):
o Will your committee be meeting BEFORE December 4th via ZOOM?
§ If yes, do you want the Section to schedule your ZOOM meeting in conjunction with other RPPTL published ZOOM Meetings (typically 1 or 2 weeks before the EC meeting)? or
§ Will you be making those ZOOM arrangements yourself and holding your meeting at a different time?
o If your committee will not be meeting before December 4th, do you intend to hold a meeting in conjunction with (ie: during the same few day period) the Executive Council meetings?
§ If yes, will your committee be:
· Meeting in person with ZOOM capability (note: if so, you need to arrange to have a committee member available to assist with moderating); or
· Meeting in person without ZOOM? (note: if meeting in person, without ZOOM, you will also likely NOT have a screen/projector)
o Are you planning to include a speaker (other than typical sub-committee or project reports) and offer CLE?
o Do you have any other special requests or require any other services for committee members during your meeting (adaptive equipment, etc.)?
o HOW MUCH TIME DO YOU ANTICIPATE YOUR MEETING WILL REQUIRE? Please base this in reality, according to your agenda. If you only have 30 minutes of material for this meeting, that is okay (from time to time) – please don’t create busy work. But space (time and member bandwidth) is always limited. Consider requesting ONLY 30 minutes for your meeting if that is all the time you need; or consider holding a ZOOM meeting only, at a different time. PLEASE respect the time of your committee members. While ending your meeting early may sound like it will be received favorably, that is time that another committee needed to address an important issue, or your colleague could have used to answer a client e-mail or return a call from their family member.
· Finally, please let me know if you or one of your committee members is interested in being considered for appointment to any of the following Ad Hoc committees under development. (While at first these may appear to be real property related issues, alone, there are aspects for consideration on the PT side):
o 99 year leases – many condos and other developments were built in the 60’s on property subject to 99 year leases. What happens as these leases are nearing termination, the condo property is owned by a trust or an estate and are no longer marketable; etc. (similar to the MRTA termination issue);
o Public Record Redaction – There are @20 categories of positions (judges, judicial assistants, police officers, etc.) whose identities are now redacted from documents recorded among the public records. This causes problems for title underwriters, but what happens when these people die? How do we locate or otherwise identify decedents’ assets for inventory or other purposes? Tracing ownership for homestead purposes?
o Document impounding – Currently being tested in Ft. Meyers, court clerks are impounding or holding documents submitted for recording under suspicion that they are fraudulent (holding up closings and potentially causing issues for those attempting to establish homestead, distributing property from a trust or requiring timely conveyance for tax or other reasons.
You are all leaders and serve a vital role in the RPPTL Section and the Florida Bar as a whole. Thank you for your continued service to the Section and to your fellow citizens of Florida. Please let me know if you have any questions about any of the above or if I can be of any help to you moving forward.
